Monday's unprecedented and outrageous search and seizure at the home of Rep. Ilhan Omar (D-MN) by armed DHS agents in the dead of night was blatant political intimidation and an obvious effort to sway the outcome of the upcoming midterm elections. As such, it is in direct violation of the long-standing '60-day' rule prohibiting non-emergency actions against candidates in the 60 days preceding an election. And also of Section 9-85.500 of the Justice Department Manual.

As our elected representative, I urge you to take immediate, vigorous action to protect the integrity of our election system by sending an open letter to the Department of Homeland Security condemning this unprecedented use of police-power to influence an election, demanding cessation of such actions, and calling for an immediate investigation into the circumstances and legality of the DHS. Make no mistake, silence in the face of election interference is complicity in it.

Background

In the pre-dawn hours of Monday October 12, multiple armed agents of the Department of Homeland Security (DHS) blocked off her residential street, demanded entry to Rep. Omar's home, conducted a search, and seized 'evidence' supposedly related to unsubstantiated  immigration offenses. Since the alleged 'crimes' occurred many years ago, there was obviously no immediate emergency or imminent threat to public safety that would justify a night time raid on a woman's home to obtain 'evidence' that could have been requested by a normal subpoena process during daytime business hours.

This action on the part of the Trump/Vance administration is blatant political intimidation and an obvious effort to sway the outcome of the upcoming midterm elections. As such, it is in direct violation of the long-standing '60-day' rule prohibiting non-emergency actions against candidates in the 60 days preceding an election. And also of Section 9-85.500 of the Justice Department Manual: "Actions that May Have an Impact on an Election." Section 9-85.500 states:

"Federal prosecutors and agents may never select the timing of any action, including investigative steps, criminal charges, or statements, for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party."

Representative Omar responded clearly and forcefully:

“This raid by Trump’s DHS is an outrageous abuse of power and an unprecedented escalation in the weaponization of federal law enforcement to target political enemies.” Rep Omar. 10/12/26

The Congressional Black Caucus declared on the same day:

“The raid carried out this morning at the home of Congresswoman Ilhan Omar by the Trump Administration is a sham designed to cast suspicion on the Congresswoman and manufacture an appearance of wrongdoing on the eve of the midterm elections, without any apparent legal basis.”
