I want to thank you for opposing the appointment of Matthew Whitaker as acting Attorney General and for your demand that he recuse himself from overseeing the Mueller investigation. It is obvious that Whitaker was appointed for the clear and express purpose of blocking investigations into Trump's high crimes and misdemeanors and the felonies of Trump cronies and business entities.
Whitaker is openly antagonistic to the fundamental American principle of nonpartisan justice which is symbolized by the blindfolds worn by Lady Justice on courthouse statues across the nation. He is also clearly inimical to the rule of law itself. By explicitly placing the president above the law he inherently opposes equal treatment for all regardless of their race, gender, class, or position. Therefore, I ask you to bring to the floor of your chamber a "Resolution of No Confidence" and insist on a roll call vote to expose the partisan nature of his appointment.
By circumventing Senate confirmation of Whitaker Trump has violated the spirit, and probably the letter, of Article II, Section 2 of the Constitution, the Attorney General Succession Act, and the Vacancies Reform Act. Therefore, as argued by Professor Laurence Tribe and other legal scholars, I urge you to consider filing suit against Whitaker's appointment on grounds that it robs the Senate of the institutional power conferred on it by the Constitution.
The Whitaker appointment is neither the first, nor likely the last, effort by Trump to suppress the Mueller investigation. Therefore, I encourage you to do everything in your power to enact the Special Counsel Independence Protection Act (S.1735/HR.3654) or some similar bill. Should you choose to attach such provisions to “must pass” legislation such as a Continuing Resolution you have my complete support, even to the extent of forcing a government shutdown over this issue of fundamental justice and the rule of law.
