The Dead List and the War Powers Act

There have been some small stories in the news recently about the Pentagon mysteriously removing the names of four soldiers killed in action in the Iran War and then — after members of Congress raised a question — restoring their names but under a different list. The obvious explanation is MAGA deception and disinformation—but it turns out that there’s a deeper layer.

Under the War Powers Act, a military action unilaterally initiated by a president must be ended within 60–90 days unless Congress authorizes its continuation. 

The Trump/Vance administration unilaterally started its war with Iran on Feb 28. Enabled by Republicans, they then stonewalled all congressional oversight efforts. The 90-day deadline expired on May 29 but the war continued and so did the administration's defiance of Congress. Eventually, even some Republicans began to grumble. On June 17, 110 days after commencement of their personally-declared war, Trump/Vance announced a truce agreement with Iran and announced "victory." Since all of the actual issues were left unresolved pending future talks, no one took it seriously -- least of all Iran and the Pentagon. On July 8, Trump/Vance declared the truce null and resumed military action which continues to this day.

In response to renewed calls for enforcement of the War Powers Act and respect for Article 1 Section 8, the section of the U.S. Constitution that grants Congress the sole power to declare war, the Trump/Vance regime are now asserting that the phony truce announcement "ended" the Iran War, and the continuing military action against Iran is a new war with a new 60-90 day War Powers Act clock. 

This came to light when the names of four American soldiers killed in action in July were officially listed as Iran War casualties, then mysteriously removed from the list to buttress the legal fiction that the Iran War is 'over' and that a new War Powers Act clock is now started. Even in death, they use GIs to advance their authoritarian MAGA political agenda. 

When questions were raised by Senator Warren (D-MA) and other Democratic members of Congress, the four names were added to a new, vaguely named "Overseas Operations Casualties" list. The number of American service members wounded and maimed since the war began in February and then since July 8 — rumored to be several hundred — is similarly being obscured and politically obfuscated. 

If this mendacious interpretation of the War Powers Act is allowed to stand (as MAGA Republicans in Congress clearly intend) it will allow any president to simply nullify the War Powers Act by going on TV to declare a "truce" or "peace" every 90 days and then continuing the war under a new name. 

Our job is to urge Democrats to continue their efforts to enforce the Constitution and the War Powers Act and for us to raise public awareness of this issue.
