Stop ICE: Immigration bills to watch

As this administration continues its assault on immigration in the United States, these are the bills to watch out for and take action on.

Federal legislation

INDIVISIBLE SF OPPOSES: Stop Illegal Reentry Act HR 3486 

Increases the sentencing guidelines for people who reenter unlawfully and are later convicted of a felony, starting from a 5 year mandatory minimum.


INDIVISIBLE SF OPPOSES: HR 875 DUI bill

Anyone who gets a DUI and is not a citizen can be deported.


INDIVISIBLE SF SUPPORTS: Visible Act S 2212  Visible Identification Standards for Immigration-Based Law Enforcement Act of 2025 (Murray, Padilla, and Booker)

Requires DHS personnel including CBP and ICE agents to display clearly legible identification, agency, name or initial, and badge numbers. Prohibits masks on CBP and ICE personnel, and requires DHS to establish disciplinary procedures for violations and to investigate complaints through its Office for Civil Rights and Liberties.

State legislation

Standby Guardianship AB1025 (Pellerin, 28th District)

This bill would authorize, if special conditions are met, a custodial parent or legal guardian of a minor child to designate a person to serve as a standby guardian of the person, the estate, or both of the minor child by completing a Standby Guardian’s Authorization Affidavit.


Health and care facilities: Information sharing SB 81 (Arreguin, 7th District)

Would prohibit health care providers, including health facilities defined under Health and Safety Code Section1250, from granting immigration enforcement access to patients or nonpublic areas without a valid judicial warrant or court order.


School sites: Immigration enforcement AB 49 (Arreguin, 7th District)

This bill would prohibit school officials and employees of a local educational agency from allowing an officer or employee of an agency conducting immigration enforcement to enter a school site for any purpose without providing valid identification and a valid, signed judicial warrant, and receiving approval from the superintendent of the school district, the superintendent of the county office of education, or the principal of the charter school. … The bill would require the local educational agency, if the officer or employee of ICE meets those requirements,  to limit access to facilities where pupils are not present.


Education equity: Immigration enforcement AB 419 (Connolly, 12th District)

This bill requires local educational agencies (LEAs) to post the “Know Your Educational Rights” immigration-enforcement action guide in all school sites, administrative buildings, and on their internet websites.


Elementary, secondary, and postsecondary education: Immigration enforcement: Notification SB 98 (Perez, 25th District)

This bill would require the governing board or body of a local educational agency to notify, as specified, all teachers, staff, other school community members that work on the school site, parent and guardians when the presence of immigration enforcement, as defined, is confirmed on the school site.  Includes elementary, secondary and post secondary education facilities.
