Dear AG Garland,

I know your department is very busy with the fallout from the January 6 insurrection, but it was particularly disturbing to see Trump-holdover Special Counsel Durham grabbing more headlines again last week, squeezing out a few more charges against Secretary Clinton’s legal team. The way your office tolerates him is in stark contrast to the dismissive way it has treated the two-volume report about Trump’s misbehavior from Special Counsel Robert S. Mueller III. 

It was also alarming to learn last week that on his way out of the White House, the former president had stolen 15 boxes of documents, including top secret classified material. I expect this theft to be prosecuted to the fullest extent of the law. I hope that a special task force is working behind the scenes to investigate Trump’s  many reckless breaches of U.S. national security, but if those investigations were entrusted to the FBI, please make sure this recent theft of classified material is added to their list. 

I also hope that you will remove any remaining Trump appointees from the Office of Legal Counsel to ensure that nothing and no one is blocking the DOJ from upholding the fundamental principle that no one is above the law.


Background

We hope that on the long list of investigations of the apparent crimes of the prior administration, Attorney General Merrick Garland has included compromising U.S. national security and revealing classified material. By the time Garland became the Attorney General, ex-president Trump had already demonstrated a reckless disregard for our national security, linked in the references below. We can now add to that long list the theft of 15 boxes of White House documents, including some material classified as top secret.

We also hope AG Garland will remove any remaining Trump appointees from the Office of Legal Counsel (OLC) so there will be no waffling about holding a former president responsible for the theft of classified material and other criminal breaches of U.S. national security. During the Mueller investigation, we learned more about the OLC, in particular how one of its memos prevented a president’s indictment while in office, even for brazen displays of obstruction of justice and other apparent crimes. We learned about how most OLC opinions are never released to Congress or the public, and that it has been the DOJ’s practice since long before Trump took office to defer to those opinions – even when considering what to do about a president who  flagrantly violated the constitution and finished his term in office by plotting a coup to defy the will of the voters and remain in office.
